What is the ZCSEFZA Interactive Gaming License?

It is a license issued to ZCSEFZA-registered enterprises for the operation of online casino, sports books, fixed odds, betting exchange, lottery, bingo and other interactive gaming under ZCSEFZA Interactive Gaming Rules and Regulations.

Are there restrictions on the terms and conditions of the license?

Bets may only be accepted from offshore players and only on offshore sporting events. ZCSEFZA-licensed operators cannot accept bets originating from within the territorial jurisdiction of the Philippines and/or on sporting events held within the country.

Is a licensee required to pay Corporate Income Tax?

No, but a ZCSEFZA licensee is subject to a special tax rate of five percent (5%) on Gross Income (net of allowable deductions) in lieu of all national and local taxes.

Are there incentives for ZCSEFZA-registered enterprises licensed for interactive gaming?

They are entitled to incentives under Presidential Decree No. 68 otherwise known as the Export Processing Zone Authority or EPZA Law and Book VI of Executive Order No. 226 otherwise known as the Omnibus Investment Code of 1987.

Until 2009, only fifty (50) interactive and restrictive licenses will be available. More may be issued after 2009.

Are offshore operators required to domicile themselves in the Philippines and incorporate a Philippine company?

Operators are required to domicile their gaming operations in Zamboanga, Philippines. ZCSEFZA, will assist in getting them domiciled therein. ZCSEFZA rules do not require them to incorporate a Philippine company. They only need an interactive gaming license and register as ZCSEFZA enterprise with the Zamboanga Economic Zone Authority.
